Black Creek Project is Re-Certified by the Low Impact Hydropower Institute at their October 23, 2008 Governing Board Meeting

Portland, Maine - (October 23, 2008) - The 3.7 MW Black Creek Project, which is owned and operated by Hydro Energy Development Corporation was re-certified as Low Impact on October 23, 2008 with an effective date of April 10, 2008. The certification expires on April 10, 2013.

APPLICATION FOR RE-CERTIFICATION

Black Creek Hydro, Inc. submitted an application for re-certification of the existing Black Creek Hydroelectric Project as a Low Impact facility. The project is located on a tributary of the North Fork Snoqualmie River (above Snoqualmie Falls) approximately 30 miles east of Seattle and 5 miles northeast of the city of North Bend. The project is a run-of-river facility (inflows equal outflows on an instantaneous basis). The project includes an 8 foot high, 46 foot long diversion dam that diverts Black Creek into a buried pipeline. The pipeline is 6,130 feet long and runs down a steep slope to the project powerhouse. The diversion creates a bypassed reach of the natural stream channel of about 1 mile. The Project was originally certified on July 21, 2003, when the Institute's Governing Board determined that the Black Creek Hydroelectric Project, FERC No. 6221, met the LIHI Certification Criteria.

In reaching its decision to re-certify the Black Creek facility, the Low Impact Hydropower Institute's Governing Board reviewed the application for certification, as well as the Application Reviewer's report and the Staff's recommendations. The Board's vote to certify Black Creek as a Low Impact facility was unanimous. There were no public commenters on the application, and therefore no party eligible to appeal the facility's certification. As a result, we are able to issue the certification effective the date the applicant filed, April 10, 2008. The certification of Black Creek is valid for five years and will expire on April 10, 2013.

CERTIFICATION DECISION

On July 21, 2003, the Institute's Governing Board determined that the Black Creek Hydroelectric Project, FERC No. 6221, meets the Low Impact Hydropower Certification Criteria.

In reaching its decision to certify the Black Creek facility, the Low Impact Hydropower Institute's Governing Board reviewed the application for certification, as well as the Application Reviewer's report and the Staff report. Both reports concluded that the facility met the certification criteria and should be certified.
